Who you’re dealing with

Carina Dataworks is a small independent software studio in Connecticut, founded by Kyle Guy. These terms cover this studio site and give a plain summary of the terms our apps share.

Each app’s own terms

Each paid app has its own Terms of Use, and those are the binding terms for that app. If this summary and an app’s terms ever differ, the app’s terms apply.

Carina Casino Night and Cozy Xmas Cats are free, with nothing to buy. Casino Night uses play chips only, which have no cash value. Its rules for accounts and data are on its privacy page.

This studio site

This site is information about the studio and its apps. It has no accounts and nothing to buy. Like our apps, it is provided as-is, and the content may change at any time.

14-day free trial, no card

LevelPenny, SkuClinic and CartonClinic each start with a 14-day free trial of full access with just an account. No card is needed and nothing is charged. There is one free trial per email address per app.

Subscriptions through Stripe

To keep using an app after the trial, you choose its plan (monthly or yearly, at the price listed on that app’s pricing page, plus any tax shown at checkout) on Stripe’s secure checkout. If you choose a plan during the trial, billing starts when the trial ends. Plans renew automatically each month or year until you cancel, and we tell you before a price change applies. Carina Dataworks never sees or stores your card.

Cancel anytime

Cancel in the app under Account › Manage billing, which opens Stripe’s billing page (LevelPenny also accepts cancellation by email). Cancelling stops the next renewal, and you keep full access until the end of the period you paid for, or the end of the trial. If you cancel before the trial ends, you’re not charged.

Refunds

As each app’s terms say, we don’t give refunds for partial periods unless the law requires it (LevelPenny’s terms add: or we agree to in writing).

If a trial or subscription ends

Nothing is deleted. Your account locks or sync pauses (the details differ per app), and your data is all there again when you subscribe. You can delete your account at any time.

Estimates, not advice

Our tools give estimates based on what you enter. They are not financial, tax, accounting, legal, shipping or other professional advice, and we don’t guarantee any profit, savings or results. You’re responsible for your data and your business decisions.

Provided “as is”

The apps are provided “as is” and “as available”, with all faults and without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We don’t promise they will be error-free, uninterrupted or secure.

Limitation of liability

To the fullest extent the law allows, Carina Dataworks isn’t liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue or data. Our total liability is limited to what you paid us for that app in the 12 months before the claim; each app’s terms set the exact cap, including what applies if you paid nothing.

Acceptable use

Don’t use our apps to break the law, infringe anyone’s rights, deceive anyone, or interfere with or attack the service, and don’t resell an app or present it as your own without our written permission. You agree to indemnify Carina Dataworks for claims that come from your use of an app or a breach of its terms, as set out in each app’s terms.

Governing law

The LevelPenny, SkuClinic and CartonClinic terms are governed by the laws of the State of Connecticut, USA, and disputes are brought in the state or federal courts located in Connecticut.
